Luke Curtain is a Registered Building Surveyor (BS-U 64116) and carries out statutory functions under the Building Act 1993 (Vic) and associated building regulations.

What information we collect when you request a fee proposal or contact us

We may collect:

• your name, email address and phone number

• the property address and relevant municipal council

• details of the proposed building work, including building classification and estimated cost of works

• drawings, plans, reports and other documents you provide or upload

• information contained in your enquiry or correspondence with us

When you become a client

We may also collect:

• owner, builder and consultant names and contact details

• information and documents required to assess a building permit application

• architectural and engineering drawings

• consultant reports

• title and property information

• planning permits and related approvals

• insurance certificates and owner-builder documentation

• inspection records and photographs taken during site inspections

• correspondence, assessments, decisions and other records relating to the project

When you use our website

Our website may collect standard technical information such as your IP address, browser type, device information, pages visited and other website usage information.

Our website is hosted using Wix. Wix and related services may use cookies and similar technologies to operate the website, maintain security and provide visitor analytics.

Why we collect and use your information

• to respond to enquiries and prepare fee proposals

• to assess building permit applications

• to assess building work against the National Construction Code, the Building Act 1993 (Vic), the Building Regulations 2018 (Vic) and other applicable requirements

• to issue building permits and other statutory documents, where applicable

• to issue directions, notices, occupancy permits and certificates of final inspection, where applicable

• to arrange and carry out required building inspections

• to communicate with owners, builders, consultants, councils and other relevant parties

• to meet regulatory, reporting and record-keeping obligations

• to manage building permit levy and regulatory reporting requirements

• to issue invoices and maintain our business and financial records

• to operate, maintain and improve our website and client systems

We do not sell personal information.

We do not use your personal information for unrelated marketing without your consent.

Who we may share information with

We only disclose personal information where it is reasonably necessary to provide our services, administer a project, meet our statutory obligations or where disclosure is otherwise required or permitted by law.

• the relevant municipal council, including where building permit documentation or other records are required to be provided or lodged

• the Building and Plumbing Commission (BPC) for building permit numbers, building permit levies, prescribed reporting, regulatory requirements and other statutory purposes

• building inspectors or contractors engaged by us to perform services relating to your project

• consultants involved in your project, such as engineers, fire safety consultants, land surveyors, architects, designers or planners

• technology and service providers used to operate our website, client portal, document storage, communications and other business systems

• our professional advisers, including accountants, lawyers and insurers, where reasonably necessary

• other persons or organisations where you have authorised us to do so or where disclosure is required by law

Some technology or service providers may store or process information outside Australia.

How long we keep your information

For building surveying matters that proceed to permit and completion, relevant building surveying records are generally retained for at least 10 years after the occupancy permit or certificate of final inspection is issued.

Copies of certain building permit documentation are also provided to the relevant municipal council in accordance with applicable building legislation and regulatory requirements.

Where an enquiry does not proceed to a building permit:

• we generally retain contact details and basic project information for up to 2 years in case you return to us about the project

• we generally delete drawings, plans and other project documents provided as part of an unsuccessful enquiry after 12 months, unless there is a legal, regulatory or legitimate business reason to retain them for longer

We may retain information for longer where required by law, where it forms part of a statutory or regulatory record, or where it is reasonably required in connection with a dispute, complaint, insurance matter or legal proceeding.

How we protect your information

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Information is stored using password-protected systems and other appropriate security measures.

Access to information held through our business systems and client portal is restricted to authorised users and service providers who require access to perform their functions.

No electronic system can be guaranteed to be completely secure. If we become aware of a data breach affecting personal information, we will investigate it and take appropriate action, including making notifications where required by law.

Accessing or correcting your information

You can ask us for access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.
